For the purposes of these Terms of Use, references to “You” and “Your” refers to the persons accessing this Website (including persons who access this site on the behalf of other persons) and “Website” includes also the mobile Website and the EDU mobile application (if available).

2. Use of the Website

Your use of this Website indicates Your agreement to be bound by and act in accordance with these Terms of Use in consideration of the access provided to the Website as detailed below.

If You disagree to these Terms of Use, You are not permitted to, and agree not to use or access to this Website.

The purpose of this Website is solely to permit You to i) view and/or check the availability of EDU services as offered by EDU in its sole discretion from time to time (hereinafter: `Services`); and ii) to make arrangements with EDU (or third-party providers) regarding the Services; iii) to purchase the Services; iv) to contact EDU.

You may only use this Website in accordance with i) these Terms of Use and the ii) General Terms and Conditions provided always that any use shall be only for Your private, non-commercial purposes. In particular, You are not permitted to:

  1. without EDU’s prior written consent, use any automated system, algorithm or software to monitor, extract, search or copy any material or data (in whole or in part) from or through using this Website (screen scraping);
  2. make any fraudulent registration or attempt regarding the use of Services;
  3. use any software, routine or device or take any action to interfere or attempt to interfere in any way with the operation of this Website or to create an unreasonably large load on this Website, whether or not this was done intentionally;
  4. attempt to obtain or obtain unauthorized access to any of EDU’s (or any third party service providers’ involved in the provision of Services) networks, accounts and/or to information about other users or EDU;
  5. link to this Website without EDU’s prior written consent.

In case of breach of these Terms of Use by you, without prejudice to any of other rights of EDU, EDU may in particular i) cancel the provision of Services to You; ii) terminate your user account always in line with the applicable General Terms and Conditions and the present Terms of Use; and/or iii) deny or block Your access to this Website; iv) set special conditions on Your access to or use of this Website.

4. Proprietary Rights

4.1

All information, data and materials on this Website (including but not limited to any logos, the appearance, structure, color scheme and layout of this Website, the software code and the underlying data and database) are subject to trade mark rights, copyright, database rights and/or other registered and unregistered intellectual property rights.

You may download and/or access materials and information on the Website that are not restricted or not subject to membership status/account. Furthermore, you are allowed to share these unrestricted materials provided that You indicate the author thereof, EDU, and the Website as the source, including a hyperlink to the corresponding part of the Website. Any use under this clause shall be solely for non-commercial purposes.

7. Governing Law and Jurisdiction

These Terms of Use and Your use of this Website and any dispute or claim arising from or in association with such matters shall be governed by and interpreted in accordance with the laws of Hungary and You agree to submit to the jurisdiction of the Hungarian courts unless any mandatory provision of the applicable law require otherwise.

7.2

Where these Terms of Use are translated into languages other than English in the event of any conflict or inconsistency the English language Terms of Use shall prevail.

7.3

EDU reserve the right to bring proceedings against any party which is in breach of these Terms of Use (defaulting party) in the courts of the location of the breach, the courts of the country of the defaulting party’s residence at EDU’s sole discretion.
